Terms of Service

Saddle is an email client and productivity application for iPhone. These Terms of Service (“Terms”) apply to the Saddle application, our website at saddlemail.com and related services (together, the “Service”).

The Service is operated by Thomas Carrington Smith, a sole trader trading as Saddle (“Saddle”, “we”, “us” or “our”), of 5 Tanner St, London SE1 3LE, United Kingdom.

By downloading, accessing, purchasing or using the Service, you agree to these Terms. If you do not agree, do not use or purchase the Service. Our Privacy Policy explains how we handle personal data and Google user data.

Saddle is intended for adults. You may use Saddle if you are at least 18, or if you are at least 13 and your parent or legal guardian agrees to these Terms on your behalf and supervises your use. Saddle is not available to children under 13.

1. Subscription Services

Saddle may offer free access, a free trial, paid features or a paid subscription (“Subscription”). The price, billing period, included features, renewal terms and any trial terms will be shown before you subscribe.

1.1 Billing and payment

If you purchase a Subscription, the payment service identified at checkout will charge your selected payment method. Where the purchase screen states that a Subscription renews automatically, it will renew for the stated billing period unless you cancel it before renewal. You authorise the payment service to charge the applicable subscription fee and taxes.

Your purchase may also be subject to the payment service's terms.

If a renewal payment cannot be collected, access to paid features may expire or be suspended after any applicable grace period.

1.2 Cancellation and refunds

You may manage or cancel a Subscription through the service that billed you, using the instructions shown at purchase or in Saddle. Unless the purchase terms say otherwise, cancellation takes effect at the end of the current billing period and you may continue using the paid features until then.

Refund requests are handled under the process of the payment service that billed you. This does not affect any cancellation, refund or price-reduction right that applicable law gives you.

1.3 Trials and price changes

Any trial duration, eligibility rules and conversion to a paid Subscription will be shown before the trial begins. We will not charge you unless the purchase flow clearly explains when payment starts and you authorise it.

We may change Subscription prices. A price change for an existing Subscription will take effect only after the notice required by the payment service or applicable law, normally from a future billing period. You may cancel before the new price applies.

2. Limited Licence

Subject to these Terms and applicable App Store rules, we grant you a limited, non-exclusive, non-transferable and revocable licence to install and use Saddle on Apple-branded devices that you own or control, for personal or internal business use. Your licence to the iPhone application is also subject to Apple's standard end-user licence agreement. The Service is licensed, not sold.

Saddle and its software, design, branding and other materials are owned by us or our licensors. We reserve all rights not expressly granted to you. Except where applicable law permits it, you may not copy, modify, resell, distribute, lease, reverse engineer, interfere with or attempt to gain unauthorised access to the Service.

You may connect only a Gmail account that you own or are authorised to use. When you connect an account, you instruct Saddle to access Gmail and carry out the email actions you choose. Those actions may change your underlying Gmail mailbox. Google may change or withdraw Gmail, its APIs or your access to them.

Saddle does not claim ownership of the content in your connected accounts. You authorise us to process that content only as needed to provide the Service and carry out your instructions.

You must not use Saddle unlawfully, to infringe another person's rights, send spam or malicious material, compromise another account, evade provider rules, disrupt the Service or introduce malicious code.

3. Your Responsibilities

You are responsible for protecting access to your device and connected accounts, and for checking recipients, content and attachments before sending email. For important or time-sensitive actions, you should confirm the result in Gmail.

Automated organisation, classification or suggestions may be incomplete or inaccurate. They are productivity aids, not professional advice or a substitute for reading the underlying message.

If you use Saddle for an organisation, you confirm that you have authority to connect and act through its accounts.

4. Service Availability

We aim to provide a reliable Service, but do not promise uninterrupted or error-free operation. Availability may be affected by your device, networks, Gmail, Google Cloud, Apple services, maintenance and events outside our reasonable control.

We may change, suspend or discontinue features for valid reasons, including improving Saddle, protecting security, complying with law or responding to changes made by Google or Apple. If a change materially disadvantages users of an ongoing paid Service, we will give reasonable notice where practicable and explain any applicable cancellation or refund rights.

5. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your mandatory consumer rights.

If we fail to comply with these Terms, we are responsible for foreseeable loss or damage caused by that failure or by our failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or for a failure caused by your device, your instructions, your breach of these Terms or a third-party service outside our reasonable control.

Saddle is intended for ordinary personal and business productivity. It is not designed for emergency, safety-critical, medical, legal, financial-trading or similar uses where a delayed, missed or incorrect email action could itself cause serious harm.

If you use Saddle wholly for business purposes, we are not responsible for loss of profit, revenue, opportunity, anticipated savings or business interruption except where applicable law requires otherwise. Subject to the liabilities that cannot legally be limited, our total liability arising from your business use of Saddle will not exceed the greater of £100 or the amount you paid for the Service during the 12 months before the event giving rise to the claim. Nothing in these Terms replaces or reduces legal rights that cannot be excluded.

6. Termination

You may stop using Saddle at any time. You can disconnect Gmail accounts, revoke Saddle's access through your Google Account and cancel any Subscription separately through the provider that billed you.

We may suspend or end access if you seriously or repeatedly breach these Terms, create a security or legal risk, or if we can no longer lawfully or technically provide the Service. Where appropriate, we will give notice and an opportunity to fix the issue. If we end a paid Service before the end of a period you have paid for and you are not at fault, you will receive any refund required by applicable law or the payment service that billed you. Provisions that by their nature should continue after termination will remain in effect.

7. Changes to These Terms

We may update these Terms to reflect changes to Saddle, our business, law, security requirements or provider terms. The current version and its date will be posted at saddlemail.com/terms.

If a change materially affects your rights or obligations, we will provide reasonable notice where practicable. If you do not agree to the updated Terms, you may stop using Saddle before they take effect. Changes will not retrospectively remove rights you have already acquired.

8. Governing Law and General Terms

These Terms are governed by the laws of England and Wales. If you are a consumer, you retain any mandatory protections and rights to bring proceedings that the law of your country gives you. If you use Saddle wholly for business purposes, the courts of England and Wales have exclusive jurisdiction.

If a court finds part of these Terms unlawful or unenforceable, the remaining parts will continue to apply. A delay in enforcing a right does not waive it. You may not transfer your rights under these Terms without our agreement. We may transfer our rights and obligations only where doing so does not reduce your protections under these Terms or applicable law.

These Terms and the documents expressly referred to in them form the agreement about your use of Saddle. Except for rights given to Apple by applicable App Store terms, they do not create rights for anyone other than you and us.
